“My child has special needs—can she still apply for an EB-5 Investment Green Card?” I have received this question numerous times in the recent past, from parents whose children have been diagnosed with an Autism Spectrum Disorder or other condition requiring special assistance. The short answer is yes, it is possible for a child with special needs to receive an EB-5 Investment Green Card. However, there are situations in which the child’s condition could undermine his or her application.

It appears that children with special needs cannot only apply for an EB-5 Green Card, but can be the principal investor.
