I wanted to dispel some fears that I hear when I talk to people about EB-5. And that is the removal of conditions. One, it is important to know that when you receive your EB-5 Green Card, it’s like any other Green Card and it has all the rights and privileges associated with the Green Card. The only requirement is that it’s conditioned on two very important things: firstly, your regional center did what it said it was going to do, the business enterprise was created and created the needed jobs; and secondly that your funds remain invested.
It’s important to know that if you select your regional center carefully, you really have very little to fear. At 21 months, we’re going to file for the removal of conditions. You’ll receive an extension of your Green Card at that time. While it’s being processed, your Green Card will remain in effect. If it takes USCIS longer than the 24 months they give you, you’ll go back to the local USCIS office and they will stamp your passport with an extension of your Green Card.
The numbers really speak for themselves. Last year, the approval rate for the removal of conditions, the I-829 you’ve heard about, was over 90%. And that’s with all the regional centers, not the excellent regional center that I know you will select.
