The EB-5 Regional Center program has been reauthorized after an 8.5 month delay. The program has been extended through September 30, 2027 with numerous changes. Most notably, the minimum investment amount has increased to $800,000 from the old $500,000 for Targeted Employment Areas and $1.05M from the old $1M for Non-Targeted Employment Areas for both regional center and direct EB-5 investments. Applicants with already pending or approved petitions will not be affected by this increase.
Another major change allows applicants and their family members who are already in the U.S. to apply for adjustment of status (AOS) concurrently with their I-526 petitions. Not having to wait for I-526 approval would geatly help these investors as they would be able to obtain their EADs much before their petitions are approved. If you have a pending I-526 and would like to file your AOS/EAD applications, please get in touch with us as soon as possible.
